What happened

Landlord applied for an order to terminate the tenancy and evict Tenant due to failure to pay rent. The application was filed after serving a valid N4 Notice, which the Tenant did not void by paying the arrears. The Tenant had vacated the rental unit prior to the hearing date.

The ruling

The tenancy is terminated effective October 15, 2021. The Tenant must pay the Landlord $7,694.71 in rent arrears and application costs, plus $41.36 per day in compensation starting September 25, 2021 until the Tenant vacates. If the Tenant pays $8,108 by September 30, 2021 or $9,366 by October 15, 2021, the Tenant can void the eviction order and continue the tenancy.
