What happened
Landlord applied for an order to terminate the tenancy and evict Tenant because the Landlord has entered into an agreement of purchase and sale of the rental unit and the purchaser in good faith requires possession of the rental unit for residential occupation.
The ruling
The tenancy is terminated effective January 31, 2023. The Tenant must move out by this date. If not vacated, the Landlord may file the order with the Court Enforcement Office for eviction enforcement starting February 1, 2023. The Board postponed the eviction considering the Tenant's circumstances under section 83 of the Act.
