What happened

Landlord applied for an order to terminate the tenancy and evict Tenants due to failure to pay rent. The application was filed after serving a valid Notice to End Tenancy Early for Non-payment of Rent (N4 Notice), which the tenants did not void by paying the arrears. The ruling

The tenancy is terminated effective March 31, 2021. The Tenants must move out of the rental unit on or before March 31, 2021. The amount of the rent deposit and interest the Landlord owes on the rent deposit exceeds the arrears of rent, compensation, and any unpaid charges related to NSF cheques which the Landlord is entitled to by $256.80. The Landlord is authorized to offset $43.68 per day for compensation for the use of the unit starting February 27, 2021 to the date the Tenants move out of the unit, and $175.00 for the cost of filing the application. If the Tenants wish to void this order and continue the tenancy, the Tenants must pay $1,575.00 on or before February 28, 2021, or $2,903.60 on or before March 31, 2021.
