What happened

Landlord applied for an order to terminate the tenancy and evict Tenants due to failure to pay rent. The application was filed after serving a valid Notice to End Tenancy Early for Non-payment of Rent (N4 Notice), which the tenants did not void by paying the arrears. The tenants had not vacated the rental unit at the time of the hearing.

The ruling

The tenancy is terminated effective January 31, 2022. The Tenants must pay $1,318.08 to the Landlord, which includes rent arrears up to January 6, 2022 and the application filing fee, less the rent deposit. The Tenants must also pay $34.36 per day in compensation for use of the unit from January 7, 2022 until they vacate. If the Tenants pay $3,376.00 on or before January 31, 2022, the eviction order will be void and the tenancy will continue.
