What happened

Landlord applied for an order to terminate the tenancy and evict Tenants due to persistent late payment of rent. The Landlord also claimed compensation for each day the Tenants remained in the unit after the termination date.

The ruling

The tenancy is terminated, and the Tenants must move out by February 7, 2023. If the unit is not vacated by that date, the Landlord may file the order with the Court Enforcement Office for enforcement. The Tenants must pay the Landlord $9,692.05 in daily compensation from September 1, 2022 to January 12, 2023, and an additional $72.33 per day from January 13, 2023 until the Tenants move out. The Tenants must also pay the Landlord $186.00 for the application filing costs. If the full amount is not paid by February 7, 2023, the Tenants will owe interest at 5.00% annually on the outstanding balance.
