What happened

Landlord applied for an order to terminate the tenancy and evict the Tenant and Unauthorized Occupants due to the Tenant transferring occupancy of the rental unit to the Unauthorized Occupants in a manner not authorized by the Residential Tenancies Act, 2006. The Landlord also applied to terminate the tenancy and evict the Tenant for substantially interfering with the Landlord's reasonable enjoyment or lawful right, privilege or interest.

The ruling

The tenancy between the Landlord and the Tenant is terminated. The Unauthorized Occupants shall move out of the rental unit on or before October 1, 2021. If the unit is not vacated by October 1, 2021, the Landlord may file the order with the Court Enforcement Office (Sheriff) for enforcement. The L2 application is dismissed as the Tenant has already vacated the unit.
