What happened

Landlord applied for an order to terminate the tenancy and evict Tenant due to non-payment of rent and persistent late payment of rent. The parties had reached a payment agreement prior to the hearing.

The ruling

The Landlord's application for eviction is denied on the condition that the Tenant pays the rent arrears and application fee in installments over a 19-month period, and continues to pay the monthly rent on time. If the Tenant fails to make the required payments, the Landlord may apply for an order terminating the tenancy and evicting the Tenant.
