What happened
Landlord applied for an order to terminate the tenancy and evict the Tenants because the Tenants gave a notice to terminate the tenancy. The Tenants filed a Set Aside Motion of the ex-parte eviction Order, arguing that the N9 notice was invalid as it only had one signature when there were two Tenants named on the notice.
The ruling
The ex-parte eviction Order HOL-10776-21 issued on June 8, 2021 is set aside and cancelled, as the N9 notice was invalid due to only having one signature when there were two Tenants named on the notice.
