What happened
Landlords applied for an order to determine whether the Residential Tenancies Act, 2006 applies to the rental unit. The parties agreed that the Tenant rents a single bedroom in the Landlords' semi-detached dwelling, and the Tenant is required to share a kitchen and bathroom facility with the Landlords, who reside in the same building.
The ruling
The Residential Tenancies Act, 2006 does not apply to this tenancy because the Tenant is required to share a kitchen and bathroom facility with the Landlords, who reside in the same building, as per Section 5(a) of the Act.
