What happened

Landlord applied for an order to terminate the tenancy and evict Tenants due to substantial interference with the Landlord's lawful rights and privileges. The Tenants were previously residents of the Landlord's rental property that was being redeveloped, and the Tenants were provided with temporary replacement units under an agreement with the Ontario Municipal Board. However, the Tenants are refusing to honor the agreement and vacate the temporary units.

The ruling

The Board found that the Tenants' refusal to proceed with the planned return to their original redeveloped units constitutes substantial interference with the Landlord's lawful rights and privileges. The hearing will be reconvened for the Tenants to lead evidence and speak to the question of relief from eviction.
