What happened

Landlord applied for an order to terminate the tenancy and evict Tenant due to failure to pay rent. The application was filed after serving a valid Notice to End Tenancy Early for Non-payment of Rent (N4 Notice), which the tenant did not void by paying the arrears.

The ruling

The tenancy is terminated effective December 11, 2017 unless the Tenant pays $5,274.64 by November 30, 2017 or $6,271.30 by December 11, 2017 to void the order. If the Tenant does not make the required payment, they must move out by December 11, 2017 and pay the Landlord $4,171.07 plus $32.77 per day from December 1, 2017 until they vacate. The Tenant may make a motion to set aside the order if they pay the required amount after December 12, 2017 but before the Sheriff enforces the eviction.
