What happened

Tenants applied for an order determining that the Landlord substantially interfered with their reasonable enjoyment of the rental unit due to excessive noise from the unit above. The Landlord investigated the complaints but found them to be unsubstantiated.

The ruling

The Tenants' application is dismissed. The Landlord was found to have responded reasonably to the noise complaints by investigating them. As the complaints were unsubstantiated, the Landlord was not in breach of section 22 of the Residential Tenancies Act.
