What happened
Landlord applied for an order to terminate the tenancy and evict Tenant due to failure to pay rent. The application was filed after serving a valid Notice to End Tenancy Early for Non-payment of Rent (N4 Notice), which the tenant did not void by paying the arrears. The tenant was still in possession of the rental unit.
The ruling
The tenancy is terminated effective December 31, 2020. The tenant must pay the landlord $11,547.35 in rent arrears and compensation, plus $32.88 per day starting November 18, 2020 until the tenant vacates. The tenant must also pay $175 in application filing costs. If the tenant pays $12,135 by November 30, 2020 or $13,135 by December 17, 2020, the eviction order can be voided and the tenancy can continue.
