What happened

Landlord applied for an order to terminate the tenancy and evict Tenant due to failure to pay rent. The application was filed after serving a N4 Notice, which the Tenant did not void by paying the arrears. The Tenant was not present at the hearing.

The ruling

The N4 Notice was found to be invalid, so the Board lacked jurisdiction to terminate the tenancy and evict the Tenant. However, the Tenant was ordered to pay $15,900 in rent arrears and $186 for the application filing fee. If the full amount is not paid by September 24, 2021, the Tenant will owe interest at 2% annually on the outstanding balance.
