What happened

Tenant applied for an order determining that Landlord failed to meet maintenance obligations under the Residential Tenancies Act, 2006 or failed to comply with health, safety, housing or maintenance standards. The issues were related to ongoing septic and water leakage problems in the rental unit.

The ruling

The Board ordered the Landlord to pay the Tenant a rent abatement of $7,200 and reimburse the $50 application fee, for a total of $7,250 owed to the Tenant. If the Landlord does not pay the full amount by February 15, 2022, the Tenant can deduct the outstanding balance from future rent payments or arrears.
