What happened

Landlord applied for an order to terminate the tenancy and evict Tenants due to failure to pay rent. The application was filed after serving a valid Notice to End Tenancy Early for Non-payment of Rent (N4 Notice), which the tenants did not void by paying the arrears. The tenants were still in possession of the rental unit on the hearing date.

The ruling

The tenancy will be terminated on October 31, 2022 unless the Tenants pay $2,195.68 by September 30, 2022 or $3,294.24 by October 31, 2022 to void the order and continue the tenancy. If the unit is not vacated by October 31, 2022, the Landlord may file the order with the Court Enforcement Office for enforcement. The Landlord owes the Tenants $1,059.66 for the rent deposit and interest, but can deduct $36.12 per day for compensation starting August 3, 2022 until the Tenants move out.
