What happened
Landlord applied for an order to terminate the tenancy and evict Tenant due to non-payment of rent. The Tenant did not void the N4 Notice by paying the arrears. The Tenant requested a payment plan, citing employment interruptions as the reason for falling into arrears. The Landlord disputed the proposed payment plan due to the Tenant's history of minimal payments and non-compliance with a previous arrangement.
The ruling
The Tenant is ordered to pay $9,351.00 to the Landlord for rent arrears and costs. A payment plan is established, requiring the Tenant to pay $300 monthly from March 3, 2023, to September 1, 2025, with a final payment of $51 on October 1, 2025. The Tenant must also pay rent on time. If the Tenant breaches the payment plan, the Landlord may apply for eviction without notice within 30 days of the breach.
