What happened
Landlords applied for an order to terminate the tenancy and evict Tenant due to non-payment of rent. The Tenant had not paid rent since August 2021, citing unemployment due to injuries, sickness, and testing positive for COVID-19. Despite multiple attempts by the Landlords to work out a payment plan, the Tenant remained unresponsive and chose to pay for other expenses instead of rent.
The ruling
The tenancy is terminated effective February 6, 2022, unless the Tenant voids the order by paying the specified amounts. The Tenant must pay $4,865.66 for rent arrears and compensation, plus $32.88 per day from January 27, 2022, until move-out, and $186.00 for application costs. The Tenant has the option to void the eviction by paying $6,186.00 by January 31, 2022, or $7,186.00 by February 6, 2022.
