What happened

Landlord applied for an order to terminate the tenancy and evict Tenant because the Tenant failed to meet a condition specified in the order issued by the Board on December 1, 2020. The Tenant filed a motion to set aside the order issued on April 13, 2021.

The ruling

Order TEL-16449-21, issued on April 20, 2021, is set aside. The Landlord's application under section 78 of the Act is dismissed. The Tenant shall pay the Landlord rent for July 2021, no later than July 7, 2021. Starting August 1, 2021, the remaining conditions in paragraph one of Board Order TEL-09157-20, issued on December 1, 2020 remain in effect.
