What happened
Landlord applied for an order to terminate the tenancy and evict Tenant due to failure to pay rent. The Tenant did not pay the full rent owed from October 1, 2019 to October 31, 2020, leading the Landlord to serve a Notice of Termination. The Tenant paid $1,293 after the application was filed, but disputed the total arrears amount as he believed he should be paying a lower rent due to his Rent Geared to Income (RGI) status.
The ruling
The Tenant is ordered to pay the Landlord $8,536 in rent arrears and costs by January 31, 2021. If the Tenant fails to make the required payments, the Landlord may apply for an order terminating the tenancy and evicting the Tenant.
