What happened
Landlord applied for an order to terminate the tenancy and evict Tenants due to persistent late payment of rent. The Tenants argued that due to COVID-19 and job loss, they may not always be able to pay rent on the 1st and requested a grace period until the 5th of the month.
The ruling
The Landlord's application for eviction is denied on the condition that the Tenants pay the full monthly rent on or before the 5th day of each month, commencing May 5, 2021 and for 12 months thereafter up to and including April 5, 2022. If the Tenants fail to comply with this condition, the Landlord may apply for an order terminating the tenancy and evicting the Tenants within 30 days of the breach.
