What happened

Landlord applied for an order to terminate the tenancy and evict Tenants due to non-payment of rent. Landlord served a valid N4 Notice, which Tenants did not void by paying arrears. Tenants were still in possession of the rental unit at the time of the hearing but were absent from the proceedings.

The ruling

The tenancy is terminated unless Tenants void the order by paying $2,764.80 by February 20, 2023. If not paid, Tenants must vacate by February 20, 2023. Landlord owes Tenants $998.61 after deducting arrears from rent deposit and interest, but can deduct $43.71 per day for use of the unit from January 6, 2023 until Tenants move out.
