What happened

Landlord applied for an order to terminate the tenancy and evict Tenants due to persistent late payment of rent. The Tenants testified that they have challenges paying rent on time due to personal circumstances and do not have a chequing account to pay rent.

The ruling

A conditional order granting relief from eviction is appropriate in this case. The Tenants shall pay the lawful rent in full and on time for each consecutive month commencing March 2022 and continuing through February 2023. If the Tenants fail to comply with the conditions, the Landlord shall be entitled to apply to the Board for an order terminating the tenancy and evicting the Tenants.
