What happened

Landlord applied for an order to terminate the tenancy and evict Tenants due to their failure to meet a condition specified in a mediated settlement issued by the Board on September 4, 2020. The Tenants filed a motion to set aside the order issued on October 1, 2021, but did not attend the hearing on November 23, 2021.

The ruling

The Tenants' motion to set aside the order is denied. The Tenants are ordered to pay the Landlord $375.00, which includes the Landlord's legal costs and the application filing fee. If the amount is not paid by December 31, 2021, the Tenants will owe 2% annual interest on the outstanding balance.
