What happened

Landlord applied to terminate the tenancy and evict Tenant due to non-payment of rent. Landlord also applied to terminate the tenancy and evict Tenant for substantially interfering with the reasonable enjoyment or lawful right, privilege or interest of the Landlord or another tenant. Landlord also claimed compensation for unpaid utilities.

The ruling

The tenancy is terminated unless the Tenant pays $13,841.25 by February 28, 2023 to void the order and continue the tenancy. If the Tenant does not pay this amount, the Tenant must move out by February 28, 2023. If the Tenant does not void the order, the Tenant must pay the Landlord $11,419.06, which includes rent arrears and the filing fee, minus the rent deposit and interest. The Tenant must also pay the Landlord $29.93 per day for use of the unit starting January 13, 2023 until the Tenant moves out. The Tenant must also pay the Landlord $912.86 for unpaid hydro bills.
