What happened

The Landlord applied for an order to terminate the tenancy of the Unauthorized Occupant, Karyn Braniff, and for compensation for the use of the rental unit. The Landlord alleged that the prior Tenant transferred the occupancy of the rental unit to the Unauthorized Occupant in a manner that was not authorized under the Residential Tenancies Act.

The ruling

The Unauthorized Occupant shall pay the Landlord $16,816.80 for the use of the unit from October 2, 2019 to August 26, 2020, and $50.96 per day for the use of the unit from August 27, 2020 until the date they move out. The Unauthorized Occupant shall also pay the Landlord $190.00 for the cost of filing the application. If the Unauthorized Occupant does not pay the full amount by September 6, 2020, they will owe interest at a rate of 2% on the outstanding balance. If the unit is not vacated by September 6, 2020, the Landlord may file the order with the Court Enforcement Office (Sheriff) for enforcement.
