What happened

Landlord applied for an order to terminate the tenancy and evict Tenant due to the Landlord requiring possession of the rental unit for the purpose of residential occupation. The Landlord also claimed compensation for each day the Tenant remained in the unit after the termination date.

The ruling

The application is dismissed because the Landlord failed to provide the required compensation to the Tenant prior to the termination date on the N12 notice, as required by Sections 48.1 and 55.1 of the Residential Tenancies Act, 2006.
