What happened
Landlord applied for an order to terminate the tenancy and evict Tenant due to complaints from other tenants about loud noises coming from Tenant's unit at various hours, including between 12:01 a.m. to 3:00 a.m., which included sounds of running, stomping, dancing and dragging furniture, interrupting the sleep of certain tenants.
The ruling
The tenancy is terminated effective August 29, 2021. The Tenant must move out of the rental unit on or before August 29, 2021. The Tenant is ordered to pay the Landlord $5,326.56 for use of the unit from March 10, 2021 to August 18, 2021, $32.88 per day for use of the unit from August 19, 2021 to the move-out date, and $186.00 for the cost of filing the application. If the Tenant does not pay the full amount by August 29, 2021, the Tenant will start to owe interest at 2.00% annually on the outstanding balance.
