What happened

Landlords applied for an order to terminate the tenancy and evict Tenant due to Tenant's failure to pay water bills, which resulted in the costs being added to the Landlord's property taxes. The Landlords served two N5 Notices of Termination, alleging the Tenant's behaviour substantially interfered with the Landlord's reasonable enjoyment of the property.

The ruling

The Tenant is ordered to pay the outstanding water utility bill of $2,222.01 by October 19, 2021 and to ensure the water account is kept in good standing with timely payments for the next 12 months. If the Tenant fails to comply, the Landlord may apply to the Board for an order to terminate the tenancy and evict the Tenant. The Tenant is also ordered to pay the Landlord's $186 application filing fee.
