What happened

Landlords applied for an order to terminate the tenancy and evict Tenant due to Tenant substantially interfering with the reasonable enjoyment or lawful right, privilege or interest of the Landlord or another tenant by failing to pay the water bill, as required by the rental agreement.

The ruling

The tenancy is terminated effective November 15, 2020. The Tenant must move out by June 29, 2021 and pay the Landlords $35,000, which represents compensation for use of the unit from November 16, 2020 to June 18, 2021, less the rent deposit and interest owed on the deposit. The Tenant must also pay $190.68 per day for compensation for use of the unit from June 19, 2021 until move-out. If the Tenant does not pay the full amount by June 29, 2021, they will owe interest at 2% annually on the outstanding balance. If the unit is not vacated by June 29, 2021, the Landlords may file the order with the Court Enforcement Office for enforcement.
