What happened

Landlord applied to terminate the tenancy and evict the Tenants due to failure to pay rent. The application was filed after serving a valid Notice to End Tenancy Early for Non-payment of Rent (N4 Notice), which the Tenants did not void by paying the arrears. The parties reached an agreement at the hearing.

The ruling

The tenancy is terminated effective December 31, 2022. The Tenants must vacate the rental unit by this date. If the unit is not vacated, the Landlord may file the order with the Sheriff for enforcement starting January 1, 2023. The Tenants must pay $2,500 by November 29, 2022, or owe the full $32,686 plus per diem interest.
