What happened

Landlord applied for an order to terminate the tenancy and evict Tenants due to failure to pay rent. The application was filed after serving a valid Notice to End Tenancy Early for Non-payment of Rent (N4 Notice), which the tenants did not void by paying the arrears.

The ruling

The tenancy is terminated effective February 28, 2022. The Tenants must move out by this date. The amount of the rent deposit and interest owed to the Tenants exceeds the rent arrears and compensation owed to the Landlord by $699.75. The Landlord is authorized to offset $84.33 per day for compensation for use of the unit starting January 25, 2022 and $186.00 for the application filing fee. The Tenants can void the order and continue the tenancy by paying $2,565.02 by January 31, 2022 or $5,130.02 by February 28, 2022.
