What happened
Landlord applied for an order to terminate the tenancy and evict Tenants due to failure to pay rent. The application was filed after serving a valid Notice to End Tenancy Early for Non-payment of Rent (N4 Notice), which the tenants did not void by paying the arrears. The tenants had vacated the rental unit on September 8, 2022, prior to the hearing date.
The ruling
The tenancy is terminated effective September 30, 2021. The tenants must pay the landlord $865.06, which includes rent arrears and the application fee, less the rent deposit and interest. The tenants must also pay $30.44 per day in compensation for use of the unit from August 5, 2021 until they vacate. The tenants can void the eviction order by paying $1,936.47 by August 31, 2021 or $2,862.27 by September 30, 2021.
