What happened
Landlords applied for an order to terminate the tenancy and evict the Tenant because the Landlords require possession of the rental unit for the purpose of residential occupation. The Landlords served a valid N12 notice on the Tenant, but the Tenant did not vacate the rental unit. The Landlords filed an L2 application.
The ruling
The application is dismissed because the Landlords failed to properly compensate the Tenant as required by Section 48.1 of the Residential Tenancies Act, 2006.
