What happened

Landlord applied for an order to terminate the tenancy and evict Tenant due to failure to pay rent. The application was filed after the Tenant did not meet a condition specified in a previous LTB order.

The ruling

The motion to set aside the previous order LTB-L-028061-23 is granted. The previous order is set aside and cannot be enforced. Order LTB-L-016979-22 is cancelled and replaced. The Tenant shall pay the Landlord $5,225.73 in arrears and costs by making monthly payments of the lawful rent plus $250 from July 2023 to February 2025, and a final payment of $225.73 on March 1, 2025. If the Tenant fails to make the payments, the Landlord can apply to the Board for an order terminating the tenancy and evicting the Tenant.
