What happened
Landlord applied to terminate the tenancy and evict the Tenants due to their behavior seriously impairing the safety of others in the residential complex. The Landlord presented witness testimony about incidents of the Tenants' yelling, confrontations, and property damage, but the Adjudicator found the evidence did not meet the high threshold of 'serious impairment' required under the Act.
The ruling
The L2 application is dismissed. The Landlord's evidence did not meet the high threshold of 'serious impairment' to the safety of others required under the Act to justify terminating the tenancy.
