What happened

Landlords applied for an order to terminate the tenancy and evict Tenants because the Landlords have entered into an agreement of purchase and sale of the rental unit and the purchaser in good faith requires possession of the rental unit for the purpose of residential occupation.

The ruling

The tenancy is terminated effective October 16, 2022. The Tenants must move out of the rental unit on or before October 16, 2022. If the unit is not vacated by that date, the Landlords may file the order with the Court Enforcement Office (Sheriff) to enforce the eviction. The Tenants shall pay the Landlords $5,227.40 in compensation for use of the unit from April 1, 2022 to September 6, 2022, less any rent deposit and interest owed. The Tenants shall also pay the Landlords $32.88 per day for use of the unit starting September 7, 2022 until the date they move out.
