What happened

Landlord applied for an order to terminate the tenancy and evict Tenants because the Landlord requires possession of the rental unit for the purpose of residential occupation. The Tenants agreed to vacate the unit by November 30, 2021.

The ruling

The Landlord's application was dismissed as the Landlord did not appear at the hearing to support the application. The N12 notice of termination remains valid, and the Tenants are free to provide the Landlord with notice of an earlier termination date.
