What happened

Landlord applied for an order to terminate the tenancy and evict Tenant due to failure to pay rent. The application was filed after serving a valid Notice to End Tenancy Early for Non-payment of Rent (N4 Notice), which the tenant did not void by paying the arrears. The tenant had not vacated the rental unit by the hearing date.

The ruling

The tenancy is terminated effective November 7, 2020 unless the Tenant pays $1,860.25 by October 31, 2020 or $3,211.94 by November 7, 2020 to void the order. The Landlord is authorized to offset amounts owed from the rent deposit. If the unit is not vacated by November 7, 2020, the Landlord may file the order for enforcement.
