What happened
Tenant filed an application alleging that the Landlord failed to meet its maintenance obligations under the Residential Tenancies Act, 2006, specifically regarding repairs to the ceiling from a water leak in the kitchen from July 2019, and repairs from a water leak in the bathroom and master bedroom from December 2020.
The ruling
The Landlord is ordered to pay the Tenant a rent abatement of $2,160.00 and $48.00 for the cost of filing the application, for a total of $2,208.00. If the Landlord does not pay the full amount by January 17, 2022, the Landlord will owe interest at 2.00% annually on the outstanding balance. If the Landlord does not pay the full amount by January 31, 2022, the Tenant may recover the amount by deducting $500.00 from the rent each month from February 2022 to May 2022 and $208.00 in June 2022.
