What happened

Landlord applied for an order to terminate the tenancy and evict Tenant due to failure to pay rent. The application was filed after serving a valid Notice to End Tenancy Early for Non-payment of Rent (N4 Notice), which the tenant did not void by paying the arrears.

The ruling

The Tribunal found that the Landlord, his wife and sons engaged in an ongoing pattern of harassment, obstruction, threats and bullying directed towards the Tenant, which constituted a serious breach of the Landlord's obligations under the Act. As a result, the Tribunal denied the Landlord's application for eviction. The Tenant was ordered to pay $3,200 in rent arrears and $175 for the application fee by March 26, 2019, after which interest would start accruing.
