What happened
Landlord applied to evict Tenant due to failure to maintain the rental unit in a state of ordinary cleanliness, which the Landlord alleges has resulted in undue damage to the rental unit. The Landlord served a valid N5 Notice, and the Tenant did not void the notice within the 7-day period.
The ruling
The tenancy is terminated effective August 15, 2020. The Tenant must vacate the rental unit by that date. The Tenant is ordered to pay the Landlord $8,678.16, which represents compensation for the use of the unit from November 22, 2019 to August 4, 2020, less the rent deposit and interest the Landlord owes on the rent deposit. The Tenant must also pay the Landlord $38.38 per day for compensation for the use of the unit from August 5, 2020 to the date the Tenant moves out, as well as $175.00 for the cost of filing the application. If the Tenant does not pay the full amount by August 15, 2020, the Tenant will owe interest at 2.00% annually on the outstanding balance.
