What happened
Landlord applied for an order to terminate the tenancy and evict Tenant due to non-payment of rent. The Tenant raised issues under Section 82 of the Residential Tenancies Act in a separate application.
The ruling
The Landlord's L1 application was amended to an L9 application for rent arrears only. The Tenant was ordered to pay the Landlord $3,510.64, which represents the rent arrears less the rent deposit, deposit interest, and a previous rent abatement order. The Tenant was also ordered to pay $19.73 per day in compensation for use of the unit starting November 1, 2021 until the Tenant vacates, and $186 for the Landlord's application costs.
