What happened
Landlord applied for an order to terminate the tenancy and evict Tenant due to failure to pay rent. The application was filed after serving a valid Notice of Termination effective August 25, 2021, which the Tenant did not void by paying the arrears. The Tenant was in possession of the rental unit on the application date.
The ruling
The tenancy is terminated effective February 20, 2022. The Tenant must pay the Landlord $17,348.81, which includes rent arrears and compensation, less the rent deposit. The Tenant must also pay $42.74 per day for compensation for use of the unit starting February 10, 2022 until the Tenant moves out. If the Tenant pays $19,686 on or before February 20, 2022, the eviction order will be void and the Tenant can remain in the unit.
