What happened
Landlord applied for an order to terminate the tenancy and evict Tenant due to failure to pay rent. The application was filed after serving a valid N4 Notice, which the Tenant did not void by paying the arrears. The Tenant had vacated the rental unit on September 8, 2022, prior to the hearing date.
The ruling
The tenancy is terminated effective January 3, 2021. The Tenant must pay the Landlord $23,996.90, which includes rent arrears up to December 23, 2020 and the cost of filing the application, less the rent deposit and interest on the deposit. If the Tenant does not pay the full amount by January 3, 2021, the Tenant will start to owe interest. The Tenant may void the order and continue the tenancy by paying $26,169.13 by December 31, 2020 or $27,798.01 by January 3, 2021.
