What happened
Landlords applied for an order to terminate the tenancy and evict the Tenant because the Tenant entered into an agreement to terminate the tenancy. The Tenant filed a motion to set aside the previous order, which was denied.
The ruling
The motion to set aside the previous order is denied. The stay of the previous order is lifted as of October 31, 2020. If the unit is not vacated by that date, the landlord may file the order with the Court Enforcement Office for enforcement. The tenant must pay October 2020 rent by October 1, 2020 and provide evidence of paid utility bills by October 31, 2020. The tenant may terminate the tenancy with 48 hours' notice if they find suitable accommodation before October 31, 2020. The landlord must provide the tenant with a reference letter by September 11, 2020.
