What happened
Landlord applied for an order to terminate the tenancy and evict Tenants due to failure to pay rent. The application was filed after serving a valid Notice to End Tenancy Early for Non-payment of Rent (N4 Notice), which the tenants did not void by paying the arrears. The tenant Andrew Tremblett had vacated the rental unit on June 24, 2020, prior to the hearing date.
The ruling
The tenancy was terminated effective September 10, 2021. The Tenant is ordered to pay $44,297.86 to the Landlord, which includes rent arrears up to August 30, 2021 and the cost of filing the application, less the rent deposit and interest on the deposit. The Tenant is also ordered to pay $98.63 per day for compensation for use of the unit starting August 31, 2021 until the Tenant vacates. If the Tenant does not pay the full amount by September 10, 2021, the Landlord may file the order with the Court Enforcement Office for enforcement.
