What happened

Landlord applied for an order to terminate the tenancy and evict Tenants due to persistent late payment of rent. The application was filed after serving a valid Notice to Terminate a Tenancy Early for Persistent Late Payment of Rent (N8 Notice), which the tenants did not void by paying the rent on time.

The ruling

The Tenant shall pay the full lawful rent owing on or before the first day of each month, commencing April 1, 2023 and for 12 months thereafter up to and including March 31, 2024. If the Tenant fails to comply, the Landlord may apply for an order terminating the tenancy and evicting the Tenant. The Tenant shall also pay the Landlord $186.00 for the cost of filing this application. If the Tenant does not pay the full amount owing on or before April 30, 2023, they will start to owe interest at 5.00% annually on the balance outstanding.
