What happened

Landlord applied for an order to terminate the tenancy and evict Tenant due to persistent late payment of rent. The Landlord served valid N8 notice and the Tenant had paid rent late 17 times in the past 17 months.

The ruling

The tenancy is terminated effective December 3, 2022. The Tenant must pay the Landlord $9,641 in compensation for use of the unit from April 1 to October 31, 2022, less the rent deposit and interest owed. The Tenant must also pay $52.60 per day in compensation from November 1, 2022 until the Tenant vacates, as well as the $186 application fee. If the Tenant does not pay the full amount by December 3, 2022, they will owe interest at 4% annually on the outstanding balance.
