What happened
Landlord applied for an order to terminate the tenancy and evict Tenant due to failure to pay rent. The application was filed after serving a valid Notice to End Tenancy Early for Non-payment of Rent (N4 Notice), which the Tenant did not void by paying the arrears. The Tenant had vacated the rental unit on December 1, 2020, prior to the hearing date.
The ruling
The tenancy was terminated effective September 30, 2020, the date the rental unit was sold. The Tenant is ordered to pay the Landlord $6,565 in rent arrears and $190 in filing costs, for a total of $6,755. If the Tenant does not pay the full amount by January 28, 2021, they will start owing interest at 2% annually on the outstanding balance.
